Booking Terms
Terms for booking individual sessions, packages and workshops with Nawee.
This English version is provided for convenience. In case of doubt, the German version (Buchungsbedingungen) prevails.
1. Scope
These booking terms apply to contracts for the educational and training services offered by David Nawee under the name “Nawee”. They apply to consumers and to businesses, unless otherwise agreed in the respective offer.
2. Services
Nawee offers English and communication training, in particular Business English, conversation and pronunciation. AI tools may also be used as a learning aid. Services can be provided online or, where provided for in the respective offer, in person in Hannover.
A free 15-minute initial consultation serves to clarify goals and the appropriate offer. It is not a paid lesson.
3. Booking and conclusion of contract
Unless expressly stated otherwise, the services presented on the website and in the booking interface do not yet constitute a binding offer to conclude a contract.
When booking via Cal.com, the customer submits a binding offer to conclude a contract by completing the booking process. For paid services, the contract is concluded as soon as Nawee confirms the booking or confirms the booking after successful payment.
When a package is purchased via the order form on the website, the contract is concluded when you click “Zahlungspflichtig buchen” (book with obligation to pay) and the payment is completed successfully. The individual sessions of the package are then scheduled individually.
After conclusion of the contract, the booking and contract information is provided to the customer on a durable medium, in particular by email, where required by law.
4. Prices and payment
The prices stated at the time of booking apply. Prices are shown as total prices in the respective offer. Nawee applies the small business regulation under § 19 of the German VAT Act (UStG); therefore no VAT is charged or shown.
Packages are paid online in the order form via the payment service provider Stripe.
Where payment by invoice is agreed, the invoice must be paid within the payment period stated on it.
5. Packages
The sessions of a package are scheduled individually with Nawee. No separate validity period applies unless stated otherwise in the respective offer.
6. Cancellation and rescheduling
Appointments can be canceled free of charge or rescheduled once up to 24 hours before the agreed start time, unless otherwise agreed in the respective offer.
In the event of cancellation or rescheduling within 24 hours before the appointment, or if the customer does not attend, the booked service may generally be deemed to have been used, or a fee may be charged in accordance with the agreed terms. Mandatory statutory rights, in particular the statutory right of withdrawal of consumers, remain unaffected.
7. No-shows and lateness
If the customer arrives late, the available training time is generally reduced by the length of the delay, unless expressly agreed otherwise. If the customer does not attend without canceling in time, section 6 applies.
In the event of technical problems on Nawee’s side, a replacement appointment will be arranged where possible. Mandatory statutory rights remain unaffected.
8. Online sessions
For online sessions, the customer needs a suitable internet connection and the necessary technical equipment, in particular a working microphone and, where required for the training, a camera. The customer is responsible for ensuring that these requirements are met at the time of the appointment.
Technical problems arising solely on the customer’s side generally do not affect the agreed appointment time. In the event of a significant technical disruption for which the customer is not responsible, a replacement appointment should be arranged where possible.
9. Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. Details can be found in the withdrawal information.
If a consumer expressly requests that a paid service begin during the withdrawal period, the statutory rules on compensation for services provided up to the time of withdrawal apply. The required declaration and information are handled separately in the ordering process.
10. Liability
Nawee is liable in accordance with the statutory provisions for damage resulting from injury to life, body or health and for damage caused by an intentional or grossly negligent breach of duty. Otherwise, liability is limited, to the extent permitted by law, to the foreseeable damage typical for the contract. Mandatory statutory liability provisions remain unaffected.
11. Consumer dispute resolution
Nawee is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
13. Final provisions
Should individual provisions of these booking terms be or become invalid, the remaining provisions remain unaffected. The invalid provision is replaced by the statutory provisions. With regard to consumers, this applies only to the extent that such a rule is legally permissible.
